Camili Safaris is not responsible for fees assessed by airlines resulting from operational and/or itinerary changes, even if Camili Safaris books the flight on behalf of the guest.

Camili Safaris is not obligated to refund costs of any purchased travel insurance.

Camili Safaris is not obligated to change or cancel safaris for any reason including, without limitation, World Health Organization, United States Department of State, Centers for Disease Control, or other advisories of any kind.

Passports, Visas, and Other Entry Requirements

It is the guest’s sole responsibility to obtain and have available when necessary the appropriate valid travel documents. Guests are strongly advised to check with the appropriate government authorities to determine the necessary documentation required for travel. International travel requires a passport that is valid for six months beyond your intended return travel date. Guests also need to have multiple consecutive blank visa pages within their passports (number varies depending on destination). Most destinations require that visas are obtained prior to travel.

Parents or guardians planning to bring a minor child without the other parent should note that some countries and airlines have strict documentation and permission requirements. Birth certificates may be required for children under 18. Some countries also require proof of vaccinations and/or negative test results for certain diseases for all travelers. Guests are encouraged to speak with a Camili Safaris representative if they are unsure of visa requirements for their destination. Camili Safaris shall not be responsible should any guest be denied entry to a country due to noncompliance with travel requirements.

Assumption of Risk

Camili Safaris purchases transportation (by aircraft, coach, boat, train or otherwise), hotel and other lodging accommodations from independent suppliers. Camili Safaris employees and directors are not liable for any injury to guests, including any negligent or willful acts of any third-party person providing goods and services.

Without limitation, Camili Safaris parties are not responsible for any injury, financial or physical loss, death, delay or damage to personal property, inconvenience in connection with provision of any goods and services whether resulting from but not limited to acts of God or force majeure, disease, illness, animals, civil unrest, criminal or terrorist activity, food poisoning, or for failure of any transportation mechanism to arrive or depart on time.

Safaris can come with inherent risks that can lead to injury, illness, or even death. Risks are exacerbated because safaris take place in remote locations, far from medical facilities. Guests assume all such risks associated with participating in safaris. If guests participate in any Activities including, but not limited to, any excursions involving animals, scuba diving, riding on animals, hot air ballooning, snorkeling, boating, zip lining, helicopter flights, high altitude treks, climbing, quad biking, parasailing, parachuting, white water rafting, kayaking, primate tracking and any other activities that Camili Safaris considers to carry inherent risks, then they fully understand and acknowledge that Activities carry with them inherent risks including serious illness, injury or death, and they take complete responsibility for their own health and safety and agree to assume all risks of injury, illness or death, whether foreseen or unforeseen, that may befall them as a result of participating in any Activities and agree to release the Camili Safaris parties from any liability whatsoever related thereto.

As consideration for being permitted to participate in the Activities, you release the Camili Safaris Parties, whether known or unknown, from, and agree not to sue or make claim against the Camili Safaris Parties, for property damage, cancellation of any Activities for any reason, illness, negligent rescue operations or procedures, personal injury, or death arising out of your participation in the Activities, and any activity related thereto, including transportation to and from the site of the Activities, regardless of whether such property damage, illness, personal injury or death results from the negligence of the Camili Safaris Parties and/or from any defect in equipment. You further agree to indemnify and hold Camili Safaris Parties harmless with respect to any claim made against the Camili Safaris Parties by anyone else (a) related to your participation in any safari or any Activities, or (b) which would be subject to the above release and covenant not to sue if you had made the claim directly yourself. Upon receipt of notice of the assertion of a claim, the Camili Safaris Parties reserve the right to approve, or withdraw approval of, counsel, in its sole discretion.

Force Majeure

Camili Safaris assumes no liability for any personal injury, property damage, financial or other loss, delay, accident, inconvenience which may be occasioned by reason of any matter beyond our control including, but not limited to, a cancellation or delay or a flight that causes guests to miss all or any portion of the safari, acts of God, epidemics, acts or orders of government, war, riots, terrorists acts, strikes or weather events.

Photography Release

Camili Safaris may take photographs or film of its safaris and safari guests. You consent to our use of pictures or video of you in our marketing materials without compensation.

Any physical or mental condition requiring medical attention or physical assistance must be reported in writing when guests make their reservation. Safari guests must be able to embark or disembark safari jeeps alone or with minimal assistance from their travel companions and climb stairs without assistance. Safari guests requiring assistance must travel with a companion who will be responsible for handling equipment and rendering assistance. Any dispute concerning, relating, or referring to this Agreement, or any other literature concerning my safari, or the safari itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. Sections 1-16, according to the then existing Comprehensive Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services, Inc. Such proceedings will be governed by the substantive (but not procedural) New York law and will take place in New York, NY. The arbitrator and not any federal, state or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. By agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury. Any arbitration commenced against Camili Safaris must be on behalf of only the signatory of this Agreement and his or her immediate family members who traveled with the signatory, such as spouse or child. Under no circumstances can participants be part of a class or other joint action.
